Can a Mortgage Company collect more than the Foreclosure Sale $ in Michigan?
So my friend is in foreclosure and is trying to figure out what is the law in Michigan and it is very confusing. It seems that if the bank takes the house and sells it then they can sue him for the difference of what they sold it for and what he owes. But it went to sheriff sale and the bank bought it from themselves, so the question is that the sale or is it the sale later to someone else that matters? And also how can he find out how much they bought it at the sheriff sale for?
So then in this case if the mortgage company bought it for say 30,000 less than the mortgage then they can sue for the difference. Do they usually do this?
